1.      OBJECT


Any order taken for a product appearing in the online store www.orapeco.fr supposes the preliminary consultation and the acceptance of the present general conditions. They govern the contractual relations between ORAPECO and its customer, both parties accepting them without

accept them without any reserve. They will prevail over all other conditions appearing in any other document, except prior, express and written derogation.  They are applicable in metropolitan France, (excluding delivery time and costs).


The consumer declares to have the full legal capacity allowing him to engage under the present general conditions. These conditions aim at defining the rights and obligations of the parties in the context of the online sale of goods and services offered by ORAPECO or its partners to the consumer. ORAPECO is the seller of its own products present on this website, and is the agent of the suppliers exhibiting their products on its online sales website and ensures all the orders and the logistics related to them.


ORAPECO reserves the right to modify or change without prior notice the products or services presented and marketed on ORAPECO.FR.


However, ORAPECO commits itself not to modify the specifications of the products or services already ordered by the customers. All the products proposed on the site are in principle available at our premises or at the supplier/Partner.


2.      Products

ORAPECO sells the products delivered by its suppliers and is also the agent of the suppliers displaying their products on its online sales site and takes care of all the orders and the related logistics. ORAPECO reserves the right to modify or change without prior notice the products or services presented and marketed on ORAPECO.COM. However, ORAPECO commits itself not to modify the specifications of the products or services already ordered by the customers. All the products offered on the site to its customers are in principle available at our premises or at the supplier's. In case of proven partial unavailability of the ordered product we will make a partial delivery. The remainder will be delivered later. In case of non-acceptance by the customer of the delivery time imposed by this unavailability, ORAPECO will propose a replacement product to its customer who will be free to accept or refuse it, in which case he will be refunded. ORAPECO presents on its website the products to be sold with the necessary descriptions allowing the consumers to know before the final order the essential characteristics of the products they wish to buy. In addition, in accordance with the article L 111-1 of the Consumer Code, the consumers have the possibility to obtain additional information by calling 06 13 16 35 92 from Monday to Friday from 8:30 am to 6 pm.


3.      Prices


The prices indicated for each product sold by ORAPECO are inclusive of all taxes. We do not charge VAT to the customer. Our partners could have a different policy regarding VAT.  The price indicated during the presentation of the product does not include the transport costs. These are shown on the shopping cart page when ordering. Any modification, at the customer's request, of the delivery, installation or warranty conditions in accordance with the tariffs presented in the articles "Delivery", "Installation" and "Warranties", of the present General Terms of Sale, will result in a reduction of the product price or in additional invoicing, as the case may be. It is understood that the net price will be brought to the attention of the customer by summary at the time of the order. When the Customer orders a product, he/she commits to purchase the said product or its price.

 
4.       Payment


To pay his order, the consumer has, at his choice, all the available modes of payment during the validation of the order form, namely: bank card, bank transfer, Aurore card, check, mandate letter or mandate cash.

5.        Delivery

During sales periods, delivery times may be extended. The delivery will be made by ORAPECO's partner carriers. It will be delivered to the address indicated by the customer who commits himself to receive the ordered product. For Corsica, DOM TOM and other countries, as well as for coastal shipping, the shipping costs will be recalculated according to the rates in force. The delivery will be carried out within the time indicated on the product sheet and during the setting with the basket.

In case of impossibility of delivery on the day of the appointment because of access difficulties, passages not previously reported, in case of absence of the customer at the appointment agreed with the carrier, or repeated unavailability of the customer, or error of delivery address due to the customer, the carrier will drop off in a partner relay point closest to the delivery address where you have to go for its withdrawal, if you want a re-passage of the carrier, additional fees will be charged by ORAPECO.FR according to the grid below:

It is imperative to unpack with the carrier and to report any damaged product.


In case of damaged delivery, the customer will have to make reservations on the carrier's slip (validated by the driver). If the

7.      Warranty

In order for the warranty to apply and before any return, you must imperatively contact ORAPECO for diagnosis, and then, if necessary, return the defective product with a copy of its invoice. A return number will be given to you by the technical department to be written very clearly on the package (without this number the package will be refused at the arrival).


Moreover, the batteries, rechargeable or not, bulbs delivered with the devices, are never covered by the guarantee. After-sales service: in all cases you will be asked for the user manual and/or the invoice of the goods delivered. Please keep these documents.


Concerning the legal guarantees of conformity, the follow-up costs will be charged to ORAPECO.


8.      Withdrawal

a) Right of withdrawal

You have the right to withdraw from this contract without giving any reason within fourteen (14) days. The withdrawal period expires fourteen (14) days after the day on which you, or a third party other than the carrier and designated by you, takes physical possession of the last good. In order to exercise the right of withdrawal, you must notify us of your decision to withdraw from this contract by means of an unambiguous statement (e.g. letter sent by post, fax or e-mail) by post to Orapeco, 15 rue du vieux moulin, 78370 Plaisir - France by Email at contact@orapeco.fr. You can use the sample cancellation form, but this is not mandatory. b) Effects of withdrawal

If you withdraw from this Agreement, we will refund all payments received from you, including delivery costs (except for any additional costs arising from the fact that you have chosen a delivery method other than the cheaper standard delivery method offered by us) without undue delay and, in any event, no later than fourteen (14) days from the day we are informed of your decision to withdraw from this Agreement. We will make the refund using the same payment method you used for the original transaction, unless you expressly agree to a different method; in any event, this refund will not incur any costs for you. We may defer the refund until we have received the goods or you have provided proof of shipment of the goods, whichever comes first.

c) Exception to the right of withdrawal

The exercise of the right of withdrawal is excluded for the following contracts:

- contracts for the supply of goods likely to deteriorate or expire rapidly ;

- contracts for the supply of a newspaper, periodical or magazine, except for contracts for subscriptions to these publications;

- contracts for the supply of goods which have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection;

- contracts for the supply of goods which, after delivery, are by their nature inseparably mixed with other articles;

- contracts for the supply of audio or video recordings or computer software when they have been unsealed by the consumer after delivery;

- contracts for the supply of goods or services whose price depends on fluctuations in the financial market beyond the control of the trader and which may occur during the withdrawal period;

- contracts for the provision of services fully performed before the end of the withdrawal period and whose performance has begun after the consumer has given his prior express consent and expressly waived his right of withdrawal;

- contracts for maintenance or repair work to be carried out urgently at the consumer's home and expressly requested by him, within the limit of spare parts and work strictly necessary to meet the emergency;

9.      Property

ORAPECO keeps the property of the ordered products until the effective and full payment of their price by the customer. If for any reason the product is delivered to a customer who did not pay, Occasion rapide can take back this product. Notwithstanding, the customer becomes responsible of the products as of their delivery.


10.  Responsibility


ORAPECO cannot be held responsible for damages of any kind, material or immaterial or physical, which could result from a bad functioning or a bad use of the marketed products. It is the same for the possible modifications of the products resulting from the manufacturers. The responsibility of ORAPECO will be, in any case, limited to the amount of the order and cannot be called into question for simple errors or omissions which could have remained in spite of all the precautions taken in the presentation of the products.

11.  Customer identification


For the remote sale, the information on the customer is obligatory. This information is essential for the treatment and the routing of the orders, the establishment of the invoices and contracts of guarantee. The lack of information leads to the non-validation of the order. This personal information can be used legally for commercial purposes by ORAPECO or its partners. However, and in accordance with the law "Informatique et Libertés", the processing of personal information related to ORAPECO customers or all email addresses collected by our websites have been declared to the Commission Nationale de l'Informatique et des Libertés

(CNIL). The customer has (article 34 of the law of January 6, 1978) a right of access, modification, rectification and deletion of the data
